and motor home dealerships, in litigation involving warranties
under state and federal law. These cases include claims under
the Uniform Commercial Code, the Consumer Legal Remedies Act,
leasing and financing statutes, the Song-Beverly Act, and
the Magnuson-Moss Act.
Title Branding

We have been on the forefront of litigating
and defending manufacturers and dealerships against claims
of improper "title-branding" under California's
stringent approach to "Lemon-Law Buybacks."
Faced with an allegation of fifteen improperly disclosed
vehicles, we prepared and tried a "test case"
before a mock jury with a former California Supreme Court
Justice acting as the presiding judge. A successful outcome
resulted in the remaining cases settling at a fraction
of the original demand. |
Consumer Financing/Advertising

LLP has defended significant and complex class action
litigation involving consumer financing and truth in
lending violations. We handle these cases throughout
the state, and are thoroughly familiar with the tactics
and strategies employed by the plaintiffs' bar.
We have served as state-wide defense
liaison counsel for the Automobile Advertising Cases
("Dowhal" cases) and helped design the defense
for those matters. We served as defense liaison counsel
for the Lease Documents Cases ("Trygar") and
played a key role in designing the defense strategy
for those cases, as well.
